Employer's Obligation to Report
Pursuant to section 37 of the Act employers of practising teachers have an obligation to submit a written report within 7 days to the Teachers Registration Board if the employer dismisses a teacher in response to allegations of unprofessional conduct or accepts the resignation of a teacher following allegations of unprofessional conduct.
Pursuant to section 39 of the Act employers have an obligation to submit a written report as soon as practicable to the Teachers Registration Board if the employer has reason to believe that the teacher’s capacity to teach is seriously impaired by an illness or disability affecting the person’s behaviour or competence as a teacher.
Pursuant to section 25 of the Act failure to comply with the above conditions may result in prosecution or an expiation fee of $315. A guilty finding following from a prosecution can incur a maximum penalty of $5,000.
