Suspension of Registration under 34a
Pursuant to section 34A of the Act the Registrar has the power to suspend the registration of a teacher when the teacher is charged with a prescribed offence (as defined in Schedule 1 of the Regulations) or the Registrar reasonably suspects that the teacher poses an unacceptable risk to children.
A notice of suspension must be personally served upon the teacher and the suspension must be subject to a review by the Board within 60 days of the suspension.
If the suspension is confirmed by the Board the suspension remains in effect until:
- The outcome of an Inquiry pursuant to section 35 of the Act;
- 120 days after the day on which the last criminal charge to which the suspension or variation relates is withdrawn or finally determined by a court; or
- The suspension is cancelled by the Board on application or by written notice.
