Pursuant to Section 52 if the Registrar becomes aware that a person who is, or who has been, registered as a teacher, or who is, or has been, the holder of a Special Authority to Teach has been charged with or convicted of offences that in the opinion of the Registrar raises serious concerns about the persons fitness to be, or continue to be, registered as a teacher the Registrar must give details of the matter to the persons employer if the person is a practising teacher. Further the Chief Executives of the Department for Education, the Catholic Education Office and the Association of Independent Schools of South Australia must also be informed. The Registrar must also notify the person concerned that this action is being undertaken.

If the details concern a person’s being charged with an offence and the charge is subsequently withdrawn or the person is subsequently acquitted, the Registrar must give notice of the withdrawal or acquittal to the persons employer and the Chief Executives of the Department for Education, the Catholic Education Office and the Independent Schools of South Australia Incorporated.
